About our Privacy Policy
At Appspace, Inc. (collectively referred to herein as “Appspace” or “we” or “our”), we are committed to providing high quality service along with the highest level of integrity in dealing with our customers. As an extension of this commitment, this Privacy Policy (this “Privacy Policy”) is designed to assist you in understanding how we collect, use and safeguard the personal information we collect and to assist you in making informed decisions when visiting http://www.appspace.com and other related proprietary websites (“Appspace Sites”). This Privacy Policy will be continuously assessed against new technologies, business practices and our customers’ needs and legal developments, and may be revised accordingly. This policy does not cover the ways in which we process personal information on behalf of our customers. For more information on our role as a processor please see our Data Processing Addendum.
Your use of Appspace Sites, including any dispute concerning privacy, is subject to this Privacy Policy and the Terms of Service. BY USING APPSPACE SITES, YOU ARE ACCEPTING THE PRACTICES SET OUT IN THIS PRIVACY POLICY AND OUR TERMS OF SERVICE. We reserve the right to modify this Privacy Policy at any time by posting the changes on this page. Your continued use of any portion of any of the Appspace Sites following posting of the updated Privacy Policy will constitute your acceptance of the changes. For your convenience and future reference, the date of this version of the Privacy Policy is set forth above.
Notice for California Consumers: Appspace is required to provide certain information to California consumers pursuant to the California Consumer Privacy Act of 2018, which was later amended by the California Privacy Rights Act of 2020 (the “CCPA”). Appspace describes the practices under which we collect information below and provides further processes to exercise any California Privacy Rights under the “Your California Privacy Rights” section.
What personally identifiable information do we collect, and when do we collect it?
General access to Appspace Sites
We collect personal information from you when you register for an Appspace product through one or more Appspace Sites and create an account. However, as a visitor to Appspace Sites, you may choose to apply for a job with us, engage in correspondence with us regarding any questions you may have, or express an interest in receiving additional information from us about Appspace and our offerings. In such situations, we may ask you to voluntarily provide personal information – such as your name, contact details, or company name.
Registration
In order to access basic services on Appspace Sites, including but not limited to, the Knowledge Center (collectively, “Services”), you must become a user by registering at no charge. You can also select a paid subscription, which offers enhanced Services and support. When you register, we ask for your first and last name, email address, company/group, country (time zone), and to enter a password of your choice (please note passwords must meet applicable industry integrity best practices and must meet Appspace requirements). Once you are a registered user, a new account is provisioned in one or more Appspace Sites and Salesforce (“CRM”), which adds to our records the following information: subscription level, registration date, and renewal date (which is twelve months from the registration date).
IP Address
When you visit Appspace Sites, we keep track of your Internet Protocol (“IP”) address. An IP address is a unique string of numbers that is assigned to your computer by your Internet Service Provider. Web servers automatically identify your computer by its IP address. Your IP address also may be used to gather broad demographic information.
Cookies
A “cookie” is a small data file that can be placed on your hard drive when you visit certain websites. To better understand how Appspace Sites are used and to improve the content of Appspace Sites, we may set a cookie on your computer. Cookies do not identify you personally. Instead, cookies merely recognize your browser. By using cookies, we can optimize experience on Appspace Sites and provide the added convenience of remembering your password and login information, thereby allowing you to bypass the login screen when accessing Appspace Sites. We may use both session cookies and persistent cookies to identify that you have logged in to the Services and to tell us how and when you interact with our Services. We may also use cookies to monitor aggregate usage and web traffic routing on our Services in order to customize and improve our Services. Unlike persistent cookies, session cookies are deleted when you log off from the Services and close your browser. Although most browsers automatically accept cookies, you can change your browser options to stop automatically accepting cookies or to prompt you before accepting cookies. Please note, however, that if you do not accept cookies, you may not be able to access all portions or features of the Services. Some third-party service providers that we engage (which may include third-party advertisers) may also place their own cookies on your browser. Note that this Privacy Policy covers only our use of cookies and does not include use of cookies by such third parties.
Location Information
In some cases, we collect and store information about where you are located, such as by converting your IP address into a rough geolocation. We may use location information to improve and personalize our Services for you.
Demographic information
We may gather demographic information from you (for example, your age) from time to time. We will not share such information with any other person or entity in a manner that identifies you as an individual, unless we let you know that at the time of collection or we have your permission.
Interest-Based Advertising
We may use third-party advertising companies that use tracking technologies to serve our advertisements across the Internet. These companies may collect information about your visits to the Appspace Sites and other websites and your interaction with our advertising and other communications. These advertising companies serve ads on behalf of us and others on non-affiliated sites, and some of those ads may be personalized, meaning that they are intended to be relevant to you based on information collected about your visits to the Appspace Sites and elsewhere over time. Other companies may also use such technology to advertise on our Appspace Sites.
You have the choice to tell us not to collect and use this information, and in some jurisdictions, we will only engage in interest-based advertising if you opt-in. Why do we collect and process your personally identifiable information?
Customized experience
We gather your personally identifiable information to provide you with a customized experience on Appspace Sites. Your personally identifiable information helps us tailor the content, Services, and products to your current and future needs.
How do we use your personally identifiable information?
E-mail
If you register for an Appspace product through one or more Appspace Sites, from time to time, we may send you e-mail messages informing you of our products and Services and also third-party products and services we believe may be of interest to you, such as new features and Services, special offers and updated information. We maintain the contents of any e-mail correspondence with you as confidential and for our internal use only, and we will use the information to improve your experience with Appspace Sites and/or provide customized e-mail communications to you.
Who do we share your personally identifiable information with?
We will not share any personally identifiable information that we have collected from you except as described below:
Information shared with our service providers
We may engage third-party service providers to work with us to administer and provide Services to you, such as processing credit card payments. The third parties have access to your personally identifiable information only for the purposes of performing such services on our behalf and are either bound to comply with our Privacy Policy or have privacy policies that protect your information.
Information shared with third parties
We will not share your personally identifiable information with third parties (aside from entities that perform services for us, as described above) unless you have “opted-in” to such sharing after registering with us and being presented with the option of “opting-in” to such sharing. When we share demographic information with third parties, we will give them aggregate information only.
No personal data we collect from you, and none of the third-party APIs used by Appspace are used to develop, improve, or train generalized/non-personalized artificial intelligence or machine learning models.
Information disclosed in connection with a business transaction
As we develop our business, we may buy or sell assets, and, depending upon the transaction, your personally identifiable information may be one of the transferred assets. In the event that we are acquired by another party, your personally identifiable information may be part of the assets transferred to the acquiring party.
Information disclosed for our protection and the protection of others
We may disclose information you provide if required to do so by law or if we have a good faith belief that disclosure is necessary to (1) comply with the law or with legal process served on us; (2) protect and defend our rights or property; or (3) act in an emergency to protect someone’s safety.
What are your options to control the use of your personally identifiable information?
Although most users of Appspace Sites tell us they value receiving special promotions and information regarding services provided by others, we recognize the importance of providing you with choice and control. If you would rather not receive e-mails about new products, promotions, or other noteworthy news, please use the e-mail subscription management feature at the foot of the e-mail you receive.
How can I access my profile, modify my profile or have my information deleted?
Access Profile
You can access the personally identifiable information collected by us by logging onto your profile page.
Update Profile
In order to become a user, you must create a profile upon registration with us. If at any time you wish to update your information, you may log onto your profile page and update your profile information.  If at any time you wish to stop receiving email communications from us, you may submit your request via the link at the bottom of any marketing emails you may receive; provided, however, some critical emails related to the operation of our products may still be sent to you if you are a registered user.
Deleting Information
Information and data are preserved as long as the profile is active. As a registered user, you can request the deletion or erasure of your profile by sending us a deletion request via email at privacy@appspace.com. If you choose to do so, you will no longer be able to log into Appspace and access its Services, but your data may be retained for a period of time in one or more Appspace Sites and/or CRM data for accounting and reconciliation purposes.
If the General Data Protection Regulation (or other applicable laws such as the UK Data Protection Act) applies to our processing of your personally identifiable information (which will be the case if you reside in a country or are a citizen of a country that is part of the European Union or European Economic Area), you have the following rights:
  • To be informed – You have the right to learn about Appspace’s collection and use of your personal data;
  • To object to, or request limited processing – You have the right to ask Appspace to stop using any portion of your personal data or to limit Appspace’s usage thereof;
  • To access and/or request data portability – You have the right to ask Appspace for copies of your personal data; or
  • To not be subject to a decision based solely on automated processing – You have the right to remove your personal data from any Appspace automated decision-making that has a legal effect upon yourself.
Appspace therefore can delete information related to your Data Subjects and your Confidential Information as defined in our End User License Agreement. Appspace will delete this data in partnership with the Cloud hosting provider by following NIST SP 800-88 Revision 1 “Guidelines for Media Sanitization” and DoD 5220.22-M “National Industrial Security Program Operating Manual” guidelines.

Data Retention

Your personally identifiable information is stored in accordance with any applicable Agreement in place; however, in most cases, information is stored only for as long as there is a need to store it in order to fulfill the purposes for which the personally identifiable information was collected, or as necessary to comply with our data retention policy. This usually means for as long as you have an active account with us and for six months after the deactivation or deletion of such account. Mandatory legislation, such as bookkeeping, account keeping, or tax legislation, may require us to store some of your personally identifiable information for longer periods.
Personally identifiable information processed based on your consent will be deleted in the event of your withdrawal of your consent.
Your California Privacy Rights
California law (under the California Consumer Privacy Act and as amended by the California Privacy Rights Act) permits Appspace customers who are California residents to request certain information about our disclosure of personal information to third parties for their own direct marketing purposes during the preceding calendar year. This request is free and may be made once a year. To make such a request, please email us at the following address: privacy@appspace.com.
If you are a California resident, California law provides you with the following additional rights with respect to your personal information:
  • The right to know what personal information we collect, use, and disclose about you. You may submit a request to know by using the information detailed in “Contacting Appspace” below. You also may designate an authorized agent to make a request for access on your behalf.
  • The right to request that Appspace delete any personal information Appspace has collected about you. You may submit a request for deletion by using the information detailed in “Contacting Appspace” below. You also may designate an authorized agent to make a request for deletion on your behalf.
  • The right to opt-out sharing of information for delivering Appspace advertisements. You may submit a request for opting out by using the information detailed in “Contacting Appspace” below. You also may designate an authorized agent to make a request for deletion on your behalf.
When you exercise these rights and submit a request to Appspace, we may verify your identity. We also may use a third-party verification provider to verify your identity. Your exercise of these rights will have no adverse effect on the price and quality of our goods or services.
For the 12-month period prior to the date of this Privacy Policy, we have not sold personal information about our users, nor do we have any plans to do so in the future.
EU-U.S. Data Privacy Framework
As defined in Section 2.2 of Appspace Data Processing Addendum, Appspace processes Customer Personal Data as set forth in customer agreements and In accordance with GDPR Art. 6, the lawful processing of information will be conducted to meet the performance of the contract (EULA) further noted in the Data Processing Addendum. As further described in the Data Processing Addendum; the categories of customer personal data processed is:
  • Data Subject – Direct identifying information (e.g., first name, last name, and email address).
  • Indirect identifying information (e.g., job title, telephone number)
  • Device identification and traffic data (e.g., Geolocation, IP addresses, cookies).

Customer agreements note the nature of processing customer personal data is conducted in order to meet the minimum requirements to use the Appspace Cloud SaaS products.
Appspace complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce.  Appspace has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF.  Appspace has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this Privacy Policy and the Data Privacy Framework Principles as concerns the Personal Data received under the Privacy Policy, the Data Privacy Framework Principles will prevail. Appspace’s compliance to the Data Privacy Framework is subject to the powers of the U.S. Federal trade Commission. In accordance with the Data Privacy Framework, Appspace may be liable for onward transfers to third parties that process personal information in a way that does not follow the Data Privacy Framework unless Appspace was not responsible for the event giving rise to any alleged damage.
If you believe that Appspace’s processing of your personally identifiable information does not correspond to what we have described in this Privacy Policy, or otherwise breaches applicable personal data legislation, you are welcome to contact us according to the Contacting Appspace section below
In the event Appspace cannot resolve your specific concerns, you may contact our third party dispute resolution provider PrivacyTrust: https://privacytrust.com/drs/appspace
The Data Protection Framework may give you the right to binding arbitration and any complaints not resolved by PrivacyTrust Independent Recourse Mechanism or Appspace may be handled in such manner as described in the Data Protection Framework.
Finally, as a last resort and in limited situations, EU individuals may seek redress from the DPF Panel, a binding arbitration mechanism, as described in the Data Privacy Framework.
What about international users’ personally identifiable information?
Your personally identifiable information may be transferred to, and maintained on, computers located in the United States. By providing us with your information, you are accepting and agreeing to that transfer. In the event your information is transferred abroad, Appspace complies with the applicable laws and requirements in the respective jurisdiction as it pertains to our obligations.
What about children’s personally identifiable information?
None of the Appspace Sites are directed to children under the age of 13. We assume that products purchased through credit card means are purchased by adults or minors supervised by a parent or guardian. We respect the privacy of parents and children and are committed to complying with the Children’s Online Privacy Protection Act (“COPPA”). Furthermore, we discourage children under the age of 13 from accessing or using Appspace Sites. In order to leverage the toolset and publish applications, you have to purchase a subscription from us and our policy is that we sell these licenses only to companies.
If a parent believes that his or her child has provided us with personal information, he or she can contact us via e-mail at privacy@appspace.com or via web/contact form located at https://www.appspace.com/contact/. We will promptly delete the information upon learning that it relates to a child under the age of 13.
We believe that parents should supervise their children’s online activities and consider using parental control tools available from online services and software manufacturers that help provide a kid-friendly online environment. These tools can also prevent children from otherwise disclosing online their name, address and other personal information without parental permission.
What else should you know about your privacy?
Security
We have security measures in place to protect against the loss, misuse, and alteration of the information under our control. These security measures include a firewall to prevent unauthorized access to our systems and encryption of all password information. Although we will exercise reasonable care in providing secure transmission of information between your computer and our servers, we cannot ensure or warrant the security of any information transmitted to us over the Internet and we accept no liability for any unintentional disclosure.
Employee Access
Our corporate values, ethical standards, policies and practices are committed to the protection of customer information. In general, our business practices limit employee access to confidential information, and limit the use and disclosure of such information to authorized persons, processes and transactions.
Links to Other Websites
Appspace Sites may contain hyperlinks and pointers to Internet sites maintained by third parties. These links are provided for your reference only. We do not control, operate or endorse in any respect information, products or services on such third-party sites and are not responsible for their content. Many third-party sites have their own privacy policies that differ from ours. This Privacy Policy only covers Appspace Sites and does not cover any other site. While we make every effort to keep your information secure, we do not control the policies of other sites.
Complaints
If you believe that our processing of your personally identifiable information does not correspond to what we have described in this Privacy Policy, or otherwise breach applicable personal data legislation, you are welcome to contact us at the e-mail address provided below. If you reside in a country or are a citizen of a country that is a part of the United Kingdom, European Union or European Economic Area, you may, as an alternative, complain to the Data Protection Authority in your country.
Responsible Vulnerability Disclosure
Appspace takes a proactive approach in the protection of our systems and our customers’ information. Our security efforts include a Responsible Vulnerability Disclosure program (“RVD”). The intent of Appspace’s RVD is to help minimize the impact of security flaws identified by “Independent Security Researchers” in our systems. We appreciate the role these Independent Security Researchers play in our efforts to keep the systems secure and protected. As part of our program, we encourage Independent Security Researchers to contact us at security@appspace.com with any potential security vulnerabilities. Please note Appspace does not currently operate a Public Bug Program and makes no offer of reward or compensation in exchange for a potential security vulnerability identified.
Changes to Privacy Policy
Any information that we collect is subject to the Privacy Policy in effect at the time such information is collected. We may, however, modify and revise this Privacy Policy from time to time. If we make any material changes to this Privacy Policy, we will notify you of such changes by posting them on the Services or by sending you an e-mail or other notification, and we will indicate when such changes will become effective.
